Here are the latest EB5 green card processing times for the I-526 Petition, the I-485 Application, and the I-829 Petition.
I-526 Petition Processing Times:
The updated processing time for the Immigrant Petition by Alien Entrepreneur (Form I-526) at the Immigrant Investor Program Office (IPO) is currently: 31.5 months to 52 months.
Processing times are updated monthly. USCIS notes that this is the estimated processing time from time they receive the I-526 Petition. They also say that they “generally” process I-526’s in the order that they receive them, meaning that there are exceptions. Another important note stated on the page is that the time range listed is “based on data captured approximately two months prior to updating the page.”
USCIS allows applicants to file an inquiry about their case if it falls “outside normal processing time.” The receipt date for a case inquiry is currently September 16, 2015. If your receipt date is on or before September 16, 2015 you can submit a case inquiry.
I-485 Application Processing Times:
The latest processing times for the Application to Register Permanent Residence or Adjust Status (Form I-485) depends on the Service Center location. For example, the California Service Center has a I-485 Application processing range of 10 months to 47 months while the Texas Service Center processing time ranges from 10 months to 20 months.
I-829 Petition Processing Times:
The updated processing times for the Entrepreneur to Remove Conditions on Permanent Resident Status (Form I-829) at the IPO is currently 22.5 months to 45 months.
Receipt date for an I-829 case inquiry is currently April 11, 2016. If your receipt date is on or before April 11, 2016, you can submit a case inquiry.
Will these processing times speed up?
In the last month, I-526 Petition processing times in particular slowed down by several months. If the investor EB5 rush that was predicted to happen prior to the new EB5 Modernization Regulation taking effect on November 21, 2019, did not actually occur as expected, the IPO office may be able to process more pending applications and lower processing times.
Another reason to have hope that processing times may speed up is due to the updated predicted wait times for investors listed during the EB5 Industry Forum. Read about the lower wait times predicted by the Chief of the Visa Controls Office, Charles Oppenheim, here.
As soon as fourth quarter FY 2019 and first quarter FY 2020 data is revealed, we’ll have a better picture of where the EB5 Program is at.

Tips for avoiding petition delays!
Use an experienced attorney to avoid any accidental petition errors, missed filing fees, missed deadlines, or lack of sufficient evidence.
