This checklist goes over the EB-5 documents applicants need to acquire for filing their I-526 Petitions.

USCIS requires applicants to provide these personal and financial EB-5 documents. Finding and making copies of these important documents as early as possible will make an applicant’s time spent at an immigration attorney’s office quicker and more productive.

Does the investor have proof that their net worth is at least $1 million? An investor can present evidence of real estate or company ownership. They can also present statements showing they received a gift.
USCIS wants to see proof that an applicant’s funds come from lawful sources. The funds can come from a variety of sources including from, but not limited to, earnings from employment, sale from real estate, a gift, an inheritance, a loan, or investment earnings. If the funds come from a gift, the applicant must present financial evidence such as bank documents that the gift came from lawful sources.
Before filing the I-526 Petition, the EB-5 applicant must transfer the funds. The $500,000 minimum investment amount plus the Regional Center fees must be deposited into an escrow account. The applicant must then show proof of where the funds and fees came from as well as confirmation that the authorized escrow account was funded.
USCIS also requires applicants to submit copies of birth certificates, marriage licenses, and passports. Spouses and children also applying for a green card under the investor’s EB-5 application must also submit these documents. They will also need to provide color photographs like they would for a passport.
An applicant will also have to provide employment history and educational background. This may include business registration, employment resume, and diplomas.
If an applicant served in the military they will need to submit records.
If an applicant has ever been convicted of a crime, they will need to submit records.
