Current Estimated Processing Time Range for I-526 Petitions

The current estimated processing time range for EB-5 I-526 petitions has been updated on USCIS.

Here’s the current processing time for the Immigrant Petition by Alien Investor (I-526 Petition) at the Immigrant Investor Office as well as the receipt date for proceeding with a case inquiry:

Current processing time range: 33 months to 50 months.

Compared to the previous I-526 petition processing time of 32 months to 49 months, the processing time range has widened slightly.

Changes to Occur:

Currently, the Immigrant Investor Program Office still states that it processes I-526 petitions on a first-in, first-out basis, but that is set to change in a little over a month’s time. Form I-526 will soon be processed using a visa availability approach. Investors from underrepresented EB-5 countries will have their petitions prioritized. This means that investors from countries that currently have EB-5 visas available or soon to be available will have their I-526 petitions sent to the top of the pile. These EB-5 investors may then see faster I-526 petition approvals.
