How Are EB-5 Dependents Defined?

One of the greatest benefits of the EB-5 Immigrant Investor Program is the ability to obtain green cards for an investor’s family under one application.

What family members can be included in the application? Who fits the definition of a dependent?

Dependents include your spouse and unmarried children under the age of 21.

Are step-children eligible dependents?

They are considered dependents as long as the marriage was created before the children turned 18 years of age.

Are adopted children eligible dependents?

Adopted children are eligible dependents if the investor can prove they were legally adopted two or more years before filing the EB-5 petition.

Can a new spouse be added to an investor’s EB-5 application during the process?

If you’re considering marriage during the EB-5 process and would like for your spouse to also obtain a visa, you can file for the spouse. They may have a long wait time.
