EB-5 Visa Bulletin for October 2019 (Start of a New Fiscal Year)

The new fiscal year will begin October 1st and that means the visa numbers are about to reset. Take a look at the up-to-date final action dates and dates for filing in the upcoming EB-5 Visa Bulletin for October 2019.

Final Action Dates

The final action dates for non-regional center applicants from India and Vietnam has advanced, but not Mainland China applicants. The Visa Bulletin for September 2019 showed India’s final action date as September 1, 2017, and Vietnam’s final action date as October 22, 2014. The Visa Bulletin for October 2019 has India advancing more than two months to November 22, 2017, and has Vietnam advancing nearly two years to October 15, 2016. Mainland China’s final action dates, however, have remained the same at October 22, 2014.

What are not in the chart, but are known are the October 2019 final action dates for the regional center category. Unfortunately, the EB-5 Regional Center Program needs reauthorization by September 30, 2019, but so far no legislation has been passed to extend the program so the U.S. Department of State wrote “U” or “unauthorized” in that row of the visa bulletin.

The regional center dates for filing for the three backlogged country are laid out in a note at the end of the visa bulletin which states, “If there is legislative action extending them for FY-2020, the final action dates would immediately become ‘Current’ for October for all countries except China-mainland born I5 and R5 which would be subject to an October 22, 2014 final action date, India which would be subject to a November 22, 2017 final action date, and Vietnam I5 and R5 which would be subject to an October 15, 2016 final action date.”

Additionally, another note in the EB-5 visa bulletin states that it is too early to predict visa availability in the coming months for China, India, and Vietnam, siting fluctuations in visa demand and other variables as reasons why.

All other countries have remained current.

Dates for Filing

The October 2019 dates for filing are all current except for Mainland China in both the regional center and non-regional center categories. The good news is that the dates for filing for Mainland China advanced nearly over a month from November 22, 2014 to January 1, 2015.
