The prior EB-5 visa bulletins showed that for the EB-5 Regional Center Program final action dates were unavailable. However, an extension was issued for the program.
Chart A indicates that the final action dates for all countries other than Mainland China remain current for both the EB-5 Regional Center Program and the non-Regional Center Program. For Mainland China applicants, the final action date is now July 22, 2014. If Mainland China applicant’s priority date is earlier than July 22, 2014, then they may proceed with the EB-5 process.
Chart B indicates the date for filing cut-off date remains current for all countries other than Mainland China. For applicants from Mainland China, the date is now September 1, 2014. Applications may be assembled and submitted to the Department of State’s National Visa center if the applicant’s priority date is before September 1, 2014, or the applicant is a national of any country other than Mainland China.
Since no reforms were made to the EB-5 Regional Center Program, the proposals made by the Department of Homeland Security may take effect relatively soon. These EB-5 regulations include:
1. Increase to the minimum investment amount
2. Changes to targeted employment areas (TEAs)
3. Other integrity reforms
