The EB-5 Program is extremely popular because it offers foreign nationals a pathway to U.S. permanent residency and ultimately citizenship. In order to fulfill the EB-5 Program requirements and obtain a green card, an EB-5 investor’s project must be successful.

  2. Get the investor I-829 Petition approval

While it would be great for a client to see their investment returned quickly and with interest, it’s not necessary to achieve the main goal, U.S. permanent residency (green card status).

Knowing that the best EB-5 project will get the investor both I-526 Petition approval and I-829 Petition approval, it’s imperative that any potential investor ask a regional center about:

  1. The number of I-526 Petitions that have been filed, approved, and denied.
  2. The number of I-829 Petitions that have been filed, approved, and denied.
  3. How many, if any, investors already had their investments returned to them and how much was returned.

Conducting careful due diligence and hiring an experienced immigration attorney will help you find the best EB-5 project.

Having an immigration attorney look over the offering documents, the business plan, terms of the escrow agreement, the job creation models, and the exit strategy.
