How To Find The Right EB-5 Visa Investment Opportunities

With one month remaining before the EB-5 Modernization Rule goes into effect and increases the minimum investment amount, investors are rushing to find the right EB-5 visa investment opportunities.

There are many EB-5 visa investment opportunities out there, but they’re not all equal in quality or even viability. Finding a project that will fulfill the EB-5 Regional Center Program requirements is essential to qualifying for green cards.

Here are 5 things investors should look into while conducting due diligence:

1. Minimal Risk

Investors cannot eliminate risk, but they can minimize it. While past success does not guarantee future success, it can still reveal a pattern of knowledge and experience. Find out the regional center’s project approval rate, their I-526 Petition approval rate, and their I-829 Petition approval rate.

2. Project Details

Investors should understand the project’s business plan, financial projections, job creation methodologies, construction timeline, budget, escrow management, exit strategies, program compliance, and permits.

3. Reputation

Does the regional center, developer and management teams have strong reputations? Consult with past investors to learn about what it was like working with these teams. How much experience have they had in constructing and managing similar projects successfully?

4. EB-5 Compliance

The EB-5 Program is complex and is about to change on November 21, 2019, when the new EB-5 rule goes into effect. Is the Regional Center team, third-party experts and international partners all educated on EB-5 compliance? An EB-5 investor’s petition can be delayed or even flat out denied if the project is not EB-5 compliant.

5. Communication

Transparency and honesty are key. EB-5 Investors are often still living in their home country while they invest in the U.S. and many of them do not speak English. It can be stressful to have a significant amount of your savings invested overseas and need to use a translator to communicate. That’s why finding a regional center and developer that communicate at all key stages of the process will alleviate much of the stress.
