November EB-5 Visa Bulletin

The U.S. Department of State Bureau of Consular Affairs released the November EB-5 visa bulletin.

Small changes were made to November’s EB-5 visa bulletin.

Chart 5A, Final Action Dates For Employment-Based Preference Cases shows that for Mainland born Chinese applicants, both the non-regional center date and the regional center dates have changed from February 22, 2014 (from October’s visa bulletin) to March 8, 2014 for November.

Additionally, Chart 5B, Dates For Filing Of Employment-Based Visa Applications shows no change for Mainland born Chinese applicants for both non-regional center as well as regional center. The date remains June 15, 2014. Prior to October, 2016, the cutoff date was May 1, 2015, a full year later than what it is now. This retrogression was due to President Obama’s November 2014 Visa Modernization Executive Action proposal that was aimed at immigration reform.

There is a large number of EB-5 applicants from Mainland China who have received petition approval but are waiting to schedule interviews. Due to this backlog, the process is likely to be slow for some time. Therefore, it may be more important than ever to get your EB-5 application and petitions in on time before the backlog becomes even worse.
