The importance of EB-5 Evidence: USCIS process EB-5 applications on a first-in, first-out basis, which is why it’s so important that your application not contain any errors. To avoid running into problems, check off this list below and get your application processed quickly.

EB-5 Evidence Checklist:

  1. Does your application have any inconsistencies? Does your pre-construction contract contain dimensions that differ across paperwork? Any inconsistencies like that will slow down your processing time. To avoid running into these hold ups, when you submit all your documents make sure you provide explanations and evidence that will reconcile these inconsistencies. It will prevent you from having to later fill out additional paperwork for evidence.
  2. Do you need documents that no longer exist? If you need to show that you worked for a company that no longer exists then provide evidence to show that that company dissolved. Whenever possible provide proof.
  3. Probative value of income: When you submit documents to make a claim, such as an income tax return, make sure that the source of the documents has value. If the source of your income tax return is from the government that will have a higher “probative value” or credibility than if the source was a family member or friend. This is to show that your funds came from lawful sources. USCIS has strict processing procedures to ensure that funds came from lawful activities.
  4. USCIS requires complete English translations of all foreign language documents submitted as evidence. Make sure that you submit all documents fully translated. Otherwise, you will receive a Requests For Clarification (RFC) document and that will drag out the process even more.

Use a qualified Immigration Law attorney to organize and submit the necessary documents to insure a smooth process. Missing, incorrectly filed, and poorly translated documents will again, drag out the process, or cause you to be flat out denied.
