I-526 Petition

USCIS EB-5 Processing Time Range Updated for I-526 Petitions

The latest EB-5 processing time for the Immigrant Petition by Alien Entrepreneur (I-526) at the Immigrant Investor Program Office (IPO) is 29.5 months to 61 months.

For a case inquiry, the receipt date must be before May 29, 2015.

How to interpret the processing time range. According to USCIS, the processing time range is how long it takes to process your case from the date that they received it. It’s important to note that the data used to create the time range was captured two months prior.

USCIS added an alert at the top of the page to notify visitors about the change in their approach to inventory management that occurred on March 31, 2020. I-526 petitions are no longer processed on a first-in, first-out basis, but on a visa availability approach. USCIS states that in the future they will update the page to reflect this change in approach.

Wondering how to interpret the processing time range?

The I-526 petition processing time range is currently 29.5 months to 61 months. The first number (29.5) refers to how long it takes to complete 50% of cases (USCIS). The second number (61) refers to how long it takes to complete 93% of cases (USCIS). Processing times are typically updated monthly.

What is the historical national average processing times for the I-526 petition for fiscal year 2020?

The historical national average processing time for FY 2020 (through March 31), is 13.1 months.
