USCIS Extends Temporary Closures To June 4: What It Means For EB-5

USCIS has extended its temporary office closures to June 4, 2020. Here’s what that means and how it may affect EB-5 Program investors.

They have suspended all services that require in-person interaction, but have continued to perform duties that do not involve direct contact with the public.

The temporary office closures at USCIS are in place to help slow the spread of Covid-19. Interviews and appointments will be rescheduled, but several services which do not require in-person contact with the public will continue to be performed.

For EB-5 petitioners, this means that applications may continue to be processed. EB-5 investors residing in the U.S. may still be able to adjust their status, but EB-5 investors abroad may need to wait until U.S. consulates and embassies reopen. Travel restrictions may also affect EB-5 investors abroad, but the latest temporary immigration suspension issued by President Trump does not affect the EB-5 Program.

  1. Does this mean i-526 petitions are prioritized during this closure and processed faster ?? Latest historical national average processing time for I-526 was 12.9 months, How does it impact i-526 filed in 2019 ?? Thanks in advance.

  2. Can somebody pending for the approval of I526 change the status of visa from B2 to F1?
