In April through June, USCIS received 1,513 I-526 petitions, approved 1,660 I-526 petitions, denied 433 I-526 petitions, and has 19,406 I-526 petitions pending.
For the fiscal year 2016, USCIS denied 1,442 I-526 petitions so far and there’s still one quarter left (Q4: July-September 2016). For perspective, for fiscal year 2015, USCIS denied 1,051 I-526 petitions. Why is the denial rate so high for 2016? It may be because USCIS has placed a heavier burden on the EB-5 investors when it comes to proving their lawful source of funds.
In April through June, USCIS received 905 I-829 petitions, approved 306 I-829 petitions, denied 74 I-829 petitions, and has 5,522 I-829 petitions pending. This quarter shows a higher denial rate than previous quarters.
