You Selected An EB-5 Project, Now What?

Have you selected an EB-5 project and are wondering what’s next? If you haven’t already hired an EB-5 immigration attorney, you may want one for the next steps.

Hiring an EB-5 immigration attorney to file your I-526 Immigrant Petition by Alien Entrepreneur for conditional permanent residency in the U.S. is highly recommended. While an investor could technically file it on their own, an EB-5 attorney knows the relevant laws and regulations. This knowledge can save an investor from receiving requests for additional evidence, or flat out denial from USCIS.

With so much on the line, a family-sized pack of green cards and a $500,000 investment, doing things the right way the first time is important.

Additionally, before you’re ready to file your I-526 petition, but just after you’ve selected a potential EB-5 project, there are a few steps you’ll need to take and having the assistance of an experienced EB-5 attorney could save you time, money and stress.

In the last several years the EB-5 Program has grown in popularity and there are now over 1,000 USCIS approved regional centers and even more projects. Not all of these regional centers and projects are trustworthy and viable. While an EB-5 project must be at-risk, there are many ways to minimize the risk and one of the main ways is to hire the right professionals.

An EB-5 attorney, in particular, can help potential EB-5 investors by conducting thorough due diligence on the project and regional center. They can:

  • Review the project documents
  • Review project structure
  • Reach out to the regional center to discuss the nature of the project
  • Conduct a litigation and lien search
  • Investigate potential issues that may arise while conducting due diligence
